Constitution

THE CODE OF XEROLCO

1. PURPOSE

   A. The Code defines the basic criminal laws of Xerolco. Other,
      lesser administrative laws are created by the Ember Consortium and bound
      under the title of Imperial Legislation.

2. JURISDICTION

   A. These laws are the supreme criminal law within Xerolco.
      Where there is conflict between this Code and an Imperial Legislation, the Code has 
      precedence.

   B. These laws apply uniformly to all citizens of any nation, within Xerolco,
      and all citizens of Xerolco, in any nation.

   C. Unless an appeal for the contrary is approved by the Obsidian Inquisition, an individual
      can be held accountable for the acts of his peers and blood.
 
3. RIGHTS

   A. All people are inherently endowed with essential rights. These are, in order 
      of importance,

     1. the right to obey and to be governed, as this is the basis of our society;

     2. the right to be obey, because our cohesion defines what we can accomplish; and

     3. the right to property, so that we can protect the rewards of our accomplishments.

4. RESTRICTIONS

   A. The rights of a noble must not deny a more essential right of another 
      noble. Where the rights of two nobles overlap, the lesser right 
      becomes a priviledge, which must be specifically granted by the other noble 
      before it can be expected.

      1. Actions of an individual must be restricted

         A. within, or with regards to, the property of another,

         B. if it restricts the abilities of the realm, or

         C. if it harms the life of an unconvicted citizen of equal or greater rank.

      2. No noble may become the property of another.

5. PENALTIES

   A. Those whose actions violate the rights of another, shall forfeit their own 
      rights.

      1. All violations of another's rights results in whatever punishment the High Inquisitor deems fit.

6. OBLIGATIONS

   A. All nobles must worship the Dark Lord Teros and enforce his teachings.

   B. All nobles with any sort of title must lead through example.

   C. All nobles must further the realm's interests whenever possible. 

   D. All nobles must denounce traitors and heretics to the appropriate council immediately.

7. ENFORCEMENT

   A. The Obsidian Inquisition shall be entrusted to enforce these laws.

   B. Suspected Criminals shall be charged and prosecuted by the High Inquisitor of 
      the Theocracy.

   C. Disrespect of this code will remove legitimacy from one's reign.

ARTICLES ON THE GOVERNMENT OF XEROLCO

PREAMBLE

In recognition that our nobles deserve a strong realm to call home and in which to worship our Lord, that the purpose of government is to provide protection and pride for its people, and that the former governments of these lands were violating the trust placed by their people to uphold these truths, it is necessary to correct this injustice by establishing a strong and centralized government of Xerolco in the promised lands of Fwuvoghor.

ARTICLE I

These Articles of Governance set forth the powers and limitations that bind the government of the Xerolco. There shall be no law passed that is in conflict with these Articles as these Articles may not conflict with the Code. These Articles cannot be amended except by a two-thirds majority of the Ember Consortium or a three-fourths majority of the citizens of Xerolco.

The Code of Xerolco creates a core set of laws which define criminal misconduct and appropriate punishment. The Code is the supreme law of the Theocracy, and is final should there be any conflict with a lesser law. The Code cannot be amended except by a two-thirds majority of the House of Ministers, including the Tlatoani Xerotl and the High Inquisitor.

ARTICLE II

The Ember Consortium shall be composed of the Theocracy's regional lords and governors as well as the priests of Teros who have become citizens of the realm. It shall compose the general administrative body of the government, and its members will be referred to as Consortis Imperii (Consors Imperii when singular).

It may also have special members. Among them are special families who, through their sacrifices and devotion to the Lord, have earned themselves a permanent seat upon the council (in alphabetical order: Chénier, Jamin, Stefanovic, Valymtor, Veritas), as well as foreign powers who may be entitled to one permanent seat to be filled by one of their diplomats, upon the Tlatoani Xerotl's approval, as long as they do the same. A three quarters approval is needed to add any person, family, or realm to this list, and no family or realm can use this clause in order to have more than one member on the Consortium. At no given time may the share of foreigners in the Ember Consortium exceed the hard limit of 25%.

The Consortium shall pass civil and criminal laws, approve changes in official diplomatic relations, create and organize a National Militia for the protection of the Theocracy from foreign invasion, and create and organize an Economic Policy to levy taxes and distribute revenues as necessary to fund the expenses and prosperity of the Theocracy. All questions before the Consortium shall be decided by a majority vote of the Consortis Imperii.

A knight of the realm shall be elected shall be chosen at the beginning of each month, or whenever the position is vacant, by the nobles to direct the politics of the realm and represent it in diplomatic affairs in accordance with the teachings of the Lord. He shall be granted the title of Tlatoani Xerotl.

A Consors Imperii of the Ember Consortium (or a citizen if none are fit for duty) shall be appointed by the Tlatoani Xerotl, with the approval of a majority of the Consortium, to direct the Obsidian Inquisition in accordance with the laws and declarations of the Consortium. He shall be granted the title of High Inquisitor.

A Consors Imperii of the Ember Consortium (or a citizen if none are fit for duty) shall be chosen at the beginning of each month, or whenever the position is vacant, by the nobles to direct the National Militia in accordance with the laws and declarations of the Consortium. He shall be granted the title of High Marshal.

A Consors Imperii of the Ember Consortium (or a citizen if none are fit for duty) shall be chosen at the beginning of each month, or whenever the position is vacant, by the nobles to direct the Treasury in accordance with the laws and declarations of the Consortium. He shall be granted the title of High Administrator.

These four members of the council will be granted the title of governors.

ARTICLE III

Each of the four governors, as others with positions of power, will have his duties and rules he will have to follow in order to keep his titles. All nobles are expected to know their rights and duties, and therefore, by accepting any form of promotion, are assumed to have agreed to abide by all articles of the Code and the Articles. Being representatives of the realm, they are also expected to live exemplar lives, and follow the tenants of the Lord as follows:

  • Protect the establishments of the Lord
  • Oppose those who would oppose the Lord
  • Oppose those who would attack the Followers
  • Live for Strength
  • Live for Obedience
  • Live for Loyalty
  • Defend and live by your Word
  • Embrace the virtues of the Lord: Loyalty, Virtue, Honesty, Respect, Courage, Dedication, Initiative, Strength, Piousness
  • Place the lives and interests of your peers above your own

ARTICLE IV

The Obsidian Inquisition of Xerolco shall be composed of the dukes, infiltrators, and priests of the realm, and shall be lead by the High Inquisitor, in order to enforce the laws and policies adopted by the Ember Consortium. The Tlatoani Xerotl shall have a seat in the Obsidian Inquisition as spectator, but will not have a vote unless granted so by another position. Inquisitors shall judge all proceedings of the Inquisition, in accordance with the laws of the Theocracy. Priests and infiltrators who are not dukes are only admissible to act as Inquisitors if they have held either profession for at least 7 consecutive days prior to a hearing.

ARTICLE V

The Theocracy of Xerolco shall be host of one or more churches, cults, or other religious orders. They shall all accept the Dark Lord Teros, patron of Xerolco. Particular cases are as follows:

  • The Blood Cult, which has adopted what remained of the original Church of Teros, shall be accepted for as long as they promote the Dark Lord.
  • Eretzism, which has aided in the realm's Ascension, shall be tolerated for as long as they do not oppose the Dark Lord.
  • All faiths who do not accept the Dark Lord Teros shall be forbidden from entering and practising in Xerolco.

  • Unfit for duty: Neither able or able to perform his rights and duties, either by his own fault or following a judgement by the Inquisition.
  • Xerolco: Place of Teros, the realm which this document concerns.

Imperial Legislation

Generic Legislation

  • Only the Obsidian Inquisition may legally cause harm to another citizen.
  • The worship of any unsanctioned religion is forbidden.
  • Should a Regional Commander not perform his duties as Consors Imperii, he can be removed from office by a 60% vote in the Ember Consortium.
  • Only a regional commander can offer collateral for another regional commander, but any citizen can offer collateral for another citizen.
  • For matters where the High Inquisitor is in doubt, but not so much that he be removed, the Ember Consortium should appoint another to oversee the trial. If he is in great doubt he should retire for another to replace him.
  • For matters where the guilt of a person is without question, having been caught in the act of malicious action with forethought, no trial need be brought to the Obsidian Inquisition and the High Inquisitor may decide based on the laws.
  • Should a citizen fail at a task and thus be labelled as unfit for duty, dishonest, shunned, lacking conviction, or any other state listed herein then the mark is to be placed in the national census for all to see.
  • Should a citizen have a label listed it can be removed by a Consortium vote.
  • A duke is allowed to request that his vassals send him a certain percentage of their income as the Tlatoani Xerotl is allowed to request that a certain amount be sent to the realm. As per every citizen's right to property, no more than 24% can be sent to the duchy, and no more than 9% to the realm, except for imperial regional commanders who are expected to sent thrice the designated realm share. Should a lord refuse, the High Inquisitor can fine him twice the amount he owes, every tax collection.
  • Urinating or defecating on public or imperial property shall be severely reprimanded.
  • One may only assume the title of Tlatoani Xerotl by either slaying the incumbent or defeating him through popular vote, only the latter is binding and immediate.
  • Duels may only occur in public areas, and must be approved and blessed beforehand by either a governor or a priest of Teros. A sealed document will suffice, they need not over watch the event.
  • Caged or tamed monsters taller than 5" or heavier than 500 lb. must be approved by local officials before entering the confines of any city or stronghold within Xerolco.
  • Undead may only be captured for academic studies within the capital and with priestly supervision and approval.
  • Humans may only be captured for academic, religious, or other purposes if they come from foreign lands and otherwise cause no diplomatic ill or are otherwise willing.
  • No building shall be taller, larger, or otherwise more prestigious than the imperial palace.
  • None may enter imperial property without invitation or risk being labelled as unfit for duty.
  • Only governors are entitled rooms within the royal palace and are otherwise able to invite fellow fidelis.
  • Disrespect to the Tlatoani Xerotl is disrespect to the realm of Xerolco and the entirety of its fidelis and zelatoris.
  • The Tlatoani Xerotl may send imperial investigators to report on any noble at any time.

Fidelis Tort

  1. The penalty shall be severe for a member of any of Xerolco's institutions who has been found guilty of accepting a bribe.
  2. Treason: he who has roused up a public enemy, handed over a fellow citizen to a public enemy or worked in the name of a public enemy must suffer exile or death.
  3. Someone who has brought a false claim to the Inquisition, and does not buy the peace of the accused, shall be brought before the High Inquisitor, and shall pay a double penalty.
  4. Those who tell falsehoods about their fellow citizens, and do not buy their peace, will suffer the penalty of shunning.
  5. The holdings of a noble are theirs, to do with as they wish so long as they break no laws and respect their vows.
  6. If one has maimed another, physically or otherwise, and does not buy his peace, let there be retaliation in kind by the wronged or the Inquisition, depending on the need. Should no agreement be reached the High Inquisitor may assign the fee.
  7. A foreigner, captured during honourable battle, is to be treated as an honour guest of the High Inquisitor, provided with comfort and not harmed as fitting a noble of honour.
  8. A foreigner, captured during dishonourable battle is to be treated as a heathen, their safety is forfeit and comfort rendered irrelevant by their disregard of honour.
  9. Every must bow upon meeting with the Tlatoani Xerotl, failure to do so may result in a fine and being labelled as shunned.

Zelator Tort

  1. No Zelator shall be permitted within the walls of Xerolco's institutions.
  2. Matters of justice among labores are to be settled by the regional commander who is their lord. The High Inquisitor may assist.
  3. No Zelator may raise his hand against a Fidelis, nor hurl insults or make damage upon their property.
  4. A noble cannot be found guilty of a crime committed against a Zelator. However another noble can challenge the offender to combat and whoever loses owes the other reparations, which may in turn be paid to the Zelator. Refusal to meet the challenge is not punishable but the noble is thus known as lacking conviction.
  5. Zelatoris not associated with any particular region forgo all their rights.
  6. Zelatoris may not look at the governors in the eye, lest they forfeit their lives.
  7. Zelatoris may not wear black or green in the presence of the Tlatoani Xerotl.

Unfit for Duty: can not legally hold office, and are considered to hold the same rank as a labores in all legal matters
Dishonest: known liar, and banished from the Obsidian Inquisition
Shunned: known to use slander
Lacking Conviction: not willing to defend their actions

By accepting the be chosen for the following positions, the candidate or title-holder is implying he has read and accepted the following vows, and will be bound to them no matter what, should he or should he not make his vows public upon entering office.

  • I shall show no mercy to the persecuted.
  • I shall embrace only Xerolco's concept of rights, no others.
  • I shall not act without the consent of the rest of the Inquisition.
  • I shall put the interests of my peers before my own.

High Marshal

  • I shall promote the will of the Lord.
  • I shall strive to excel personally.
  • I shall strive to improve the military.
  • I shall obey to the will of the Ember Consortium.
  • I shall show no mercy to the enemy.
  • I shall put the interests of my peers before my own.

High Administrator

  • I shall promote the will of the lord.
  • I shall strive to excel personally.
  • I shall strive to improve the realm.
  • I shall put the interests of my peers before my own.
  • I shall act in accord with the Ember Consortium.
  • I shall not seek self-profit.

Regional Commander

  • I shall not construct any heathen temples.
  • I shall put the interest of my knights before my own.
  • I shall not remove my domain from the Tlatoani Xerotl's dominion without approval from the Consortium.
