Protections of the Noble Interest: Commoners

The official protections of the noble interest in commoners will be outlined in this document pertaining to the protection of commoners to the end that they serve the noble interest. The document aims to make clear that despite unlimited noble superiority over the common class, the unwarranted attack on commoners can damage the prospects of fellow nobles and therefore must be prevented to ensure to prosperity of the Grand Duchy of Fissoa.

Preface

The following clarifications are necessary to comprehend in this manner to fully appreciate what the legislature communicates and to prevent sabotage from dangerous opportunists.

Rights: The inalienable privileges handed to a man that may not be infringed upon by any other man lest he wish to face the harsh hand of the law. Only those of noble blood are eligible to be protected under the law to this degree: only nobles have rights.

Commoner Protections: The prevention of harm to the common class to prevent damage to the noble class. This does not imply inherently to all commoners and must be justified by the service the commoner gives.

Realm Interests: The interests of the nobility of the Grand Duchy of Fissoa defined the by official aims of the the council (e.g. if a general orders to attack a region it is officially in the interest of the realm.)

The Official Legislation

  • Article 1: Commoners are to be recognized for their service to the realm and protected in their ability to do so. This will, however, be overrided if a noble has a justified grievance with the commoner.
    • 1.1: Any disrespect spoken or even implied through the commoners actions can be interpreted as justified.
    • 1.2: Disrespect encompasses any action that does not recognize noble superiority over commoners.
  • Article 2: Commoners must always accept that they are of a lower caste and have no place to question the judgement of nobility. Only a noble may raise concerns about the treatment of a commoner to the end that his interests have been damaged in the attack of said commoner.
    • 2.1: Any commoner being defended by the nobility must be defended on the basis of damage done to the nobles property or potential property. Any complaints appealing to "unfairness" to the commoner will be completely discarded, even if the complaint would be otherwise legitimate.
    • 2.2: The emphasis of the trial will weigh the damage done to the said noble through the attack on the commoner vs the damage that may be done on the principle of noble superiority as a result of judgement passed.
    • 2.3: A noble may claim the service of a commoner if the commoner is providing any type of service which furthers that nobles interests.
  • Article 3: Commoner "rights" will be officially regarded as an incendiary position that opposes the nobility.
    • 3.1: If a noble openly declares he wishes rights for commoners then he will be deemed dangerous and will not be protected with rights outlined in this document. Thereforce he will not be permitted to communicate with any commoner or punishment will ensue.
  • Article 4: If a noble has a grievance with a commoner he may send him to the dungeon and send his case to the judge, the judge will then decide on the punishment (if punishment is warranted.)
    • 4.1: If a noble repeats a false arrest of a commoner, the commoner will be released immediatly and if the commoner was completin important work for a noble, then the noble who initially arrested the commoner will be cautioned for impeding the work of said noble.
    • 4.2: Lords will have the unlimited ability to arrest or beat up any commoner who enters their region unless circumstances in section 4.3 are in play.
    • 4.3: If a noble recieves the permission from a lord for a certain commoner to enter their region, then the lord may only arrest the commoner on the terms mentioned in section 1.1 and 1.2 or else he will have violated the trust of other nobles and is accountable by the law.
    • 4.4: If a lord is short on time and cannot answer a request for permission. Then the noble asking permission may assume permision granted after 3 days of no response.
    • 4.5: If a lord wishes to absolve the permission he has given, he must order the commoners to leave his region before reversing his permission.
  • Article 5: If a commoner has no connection to any noble then he can be beaten and arrested up at will but no punishment will follow once the commoner reaches Fissoan dungeons.
    • 5.1: Oathes between nobles and commoners are not protected by law, and therefore nobles are not bound to uphold promises to commoners. However if the commoner decieves a noble, he will be instantly wanted and executed.

Notes

Commoners who aim to strive for the Grand Duchy's aims are encouraged to join the Fissoa Verminators due to the danger posed to them by not doing so (as outline in Article 5.) Alternatively they may find a noble to serve.

Punishments are currently being deliberated but currently: nobody will be banished under this legislation, although this is likely to change.
